Terms and Conditions

These terms and conditions shall apply to all orders for goods received by ‘S. S. Pandian & Sons’. No other conditions whether or not inconsistent with these conditions shall apply. It is very important that you read and understand them. These conditions do not affect your statutory rights. Acceptance of Orders

All orders are accepted by SSP subject to these conditions of sale. No variation of these conditions will be accepted unless previously agreed upon in writing by the Managing Director of SSP. Orders will only be binding upon receipt of written confirmation from SSP, who reserves the right to refuse any order. In the event of any pricing error occurring within this website, within any fax or e-mail correspondence, however received, all incomplete orders shall be deemed void.

Customer’s Authority

Customers entering into transactions with ‘S. S. Pandian & Sons’ expressly warrant that they are authorised to accept and are accepting these conditions not only for themselves but also as agents for and on behalf of all other persons who are, or may become, interested in ‘S. S. Pandian & Sons’ goods or products, whether in whole or part.

Payment

We accept online payment through Paypal and/or other digital wallets/payment gateways provided by reputed banks and service providers. We do not store credit card details nor do we share customer details with any 3rd parties. If you are shopping from outside India, place your order and your credit card company or bank will convert the transaction to your own currency. Payments can be accepted in Indian Rupees (INR). Trade / Wholesale customers may pay by credit/debit cards only at the time of placing an order. ‘S. S. Pandian & Sons’ will assess your company details and provide you with the appropriate credit limit which will be time-based on your trading history. Otherwise invoices must be paid by credit card at the time of purchasing. All orders for goods are subject to stock availability. If we do not supply goods to you for any reason, we will inform you of the situation and will not charge you for those goods. We will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of an un-fulfilled order.

Prices

All prices quoted or displayed are in Indian Rupees (INR) at the time your order is placed. We are entitled to make adjustments to the price to take into account any increase in, or imposition of new, taxes or duties. If due to an error or omission, the price published for the goods on our website is wrong, we have the right to terminate an order provided the goods have not been dispatched.

We will try to ensure that all prices displayed on our website are accurate, but should an error occur, we would inform you of the correct price and give you an opportunity to cancel the order. Please note that the prices quoted are subject to availability and ‘S. S. Pandian & Sons’ reserves the right to refund the payments to you if the database processes your order in error. Every effort will be made to maintain a stable supply and pricing policy subject to market conditions and variations. ‘S. S. Retention of Title

All goods supplied by ‘S. S. Pandian & Sons’ to the customer shall remain the property of ‘S. S. Pandian & Sons’ until such time as ‘S. S. Pandian & Sons’ receives payment in full for the goods and of all other monies due to ‘S. S. Pandian & Sons’ from the customer. Until such payment as aforesaid is received, the separate identity of those goods shall be maintained by the customer. After delivery of the goods to the customer or his nominated sub-purchaser, the goods shall be at the customer’s risk and the customer shall insure those goods against loss or damage.

Until such time as title in the goods shall pass to the customer in accordance with the foregoing provisions, ‘S. S. Pandian & Sons’ shall be entitled at any time to repossess the goods whether with or without notice and SSP and its employees or agents shall have the right, at any time, to enter upon the premises of the customer for the purpose of effecting such repossession.

Force Majeure

‘S. S. Pandian & Sons’ will not be liable to you for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and, if so delayed, we shall be entitled to a reasonable extension of time for performing such obligations.

No Warranty

Goods are supplied according to the descriptions and specifications given by the manufacturer. ‘S. S. Pandian & Sons’, and its employees or agents are not authorised to make any representations concerning the goods unless strictly confirmed in writing. In entering into this agreement you acknowledge that you do not rely on any such representation to complete your purchase with us. We make no warranty as the suitability of any goods for any particular purpose. Health Foods are not medicines, thus ‘S. S. Pandian & Sons’ cannot and are not authorised to guarantee results. In entering into this agreement you acknowledge that there are no guarantees for the purpose of the goods.

Deliveries

While every effort will be made to supply orders promptly, ‘S. S. Pandian & Sons’ will not accept responsibility for suspension or delay in deliveries or for the consequences thereof. In general, the price quoted is for delivery to the reception desk and/or ground floor at the stated delivery address. We use courier service to deliver our goods depending on the size, value and destination of your order. We aim to dispatch all orders received between 9:00 AM to 6:00 PM on Mondays through Fridays within 24-48 hours of receiving the payment. For all other orders, we aim to dispatch within 48-96 hours of receiving the payment. ‘S. S. Pandian & Sons’ takes a certificate of posting from our courier providers for all dispatched goods. A signature will be required at the time of delivery. ‘S. S. Pandian & Sons’ will not accept responsibility for suspension or delay in deliveries nor for the consequences thereof once the goods have left our premises by any of our nominated carriers. Free Delivery is offered to customers in India who place an order to a India address.

Proof of Posting

Every item of posting being dispatched is recorded by the courier provider as evidence of your order being dispatched.

Receipt of Goods

Receipt of Goods should be signed for as “unexamined”. It is the responsibility of the recipient at the customers’ premises, or on behalf of the customer, to count and check that all boxes and goods that are delivered are as per the accompanying delivery note. Any damages or shortages must be reported immediately by phone and in writing within THREE working days of delivery, otherwise no claim will be considered. The complete packaging must be retained if pilfering is suspected or if breakage has occurred. Due to the need to adhere to the highest standards of health, safety and hygiene, shortfalls cannot be rectified if these procedures are not strictly adhered to.

Non-Delivery

An invoice or receipt is usually sent together with the goods or a day after the goods have been dispatched. In the event of non-arrival of goods, customers must inform ‘S. S. Pandian & Sons’ within FIVE days of the invoice date, otherwise no claim will be considered.

Proper Law

All contracts made with ‘S. S. Pandian & Sons’ and any and all disputes arising therefrom shall be governed by and construed according to the Indian Law and the purchaser submits to the exclusive jurisdiction of the Courts at Bangalore. These terms of trade will prevail over any conditions that shall be issued by the customer. The customer should not rely on any representations made by staff as they do not form part of the contract or collateral contract.

Any typographical, clerical and other omissions or errors, however made, in any of ‘S. S. Pandian & Sons’ literature, quotations, price lists, invoices or any other documents or information supplied by the company shall be subject to correction without any liability on the company’s part.
